Please read these Terms & Conditions carefully before booking a tour or using our services. By booking a tour, paying a deposit, or participating in an Adventura Motorcycle Tours itinerary, you (“Customer”, “rider”, “participant”, “you”) agree to be legally bound by these terms.

1. Booking, Payments, and Final Balance

• Booking Deposit: A non-refundable deposit of thirty percent (30%) of the total tour cost is required at the time of booking to secure your motorcycle allocation and initial accommodation bookings.
• Final Balance: The remaining balance must be paid in full no later than fifty-two (52) days prior to the official scheduled tour start date.
• Failure to Pay: If the remaining balance is not received by the specified deadline, the Company reserves the absolute right to treat the booking as cancelled by the customer, and any deposit paid will be completely forfeited.

2. Strict Cancellation and Refund Policy

Because the Company enters into binding, non-refundable financial contracts with premium hotels, fleet management providers, and local vendors well in advance of the tour, our cancellation policies are strictly enforced without exception:

• Cancellation 52+ Days Before Departure: If you cancel your tour booking fifty-two (52) days or more before the scheduled tour start date, you will receive a refund of any monies paid, minus the non-refundable 30% booking deposit.
• Cancellation 51 Days or Fewer Before Departure: If you cancel your tour fifty-one (51) days or fewer prior to the scheduled tour start date, or if you fail to attend the tour (“no-show”), no refunds will be issued under any circumstances. At this stage, 100% of the tour booking cost is non-refundable.
• Tour Modifications: The Company reserves the right to modify tour routes, scheduled accommodations, or itineraries due to weather, road safety, or force majeure events. No refunds or price reductions will be offered for such operational adjustments.

3. Mandatory Customer Insurance Requirement (Release of Liability)

The Company does not provide medical, personal injury, trip interruption, or personal property insurance. You are solely responsible for your own protection.

• Mandatory Travel & Medical Insurance: As a strict condition of booking, all participants must independently source and maintain comprehensive international travel, medical, and repatriation insurance that explicitly covers riding large-displacement motorcycles in foreign territories.
• Proof of Insurance: The Company reserves the right to request proof of active, comprehensive insurance coverage before allowing a participant to join a tour.
• Zero Out-of-Pocket Claims: Under no circumstances will MONTBLVN LLC be held financially responsible for medical bills, emergency evacuations, flight cancellations, luggage loss, or trip interruptions. All such costs are your sole responsibility.

4. Motorcycle Rental, Damage Excess, and Security Deposit

• Security Deposit Hold: On the first day of the tour, a mandatory security deposit / insurance excess of 1.500€ per motorcycle must be authorized on your credit card.
• Release of Funds: This hold is a temporary authorization required by our fleet providers. It will be released in full at the end of the tour, provided the motorcycle is returned on time, undamaged, and in the exact condition it was delivered to you.
• Damage Liability: If any damage occurs to the motorcycle during the tour, the cost of repairs up to the full deductible amount (1.500€) will be deducted directly from your security deposit hold.

5. Rider Requirements, Passports, and Licensing

• Valid Licensing: Every participant operating a motorcycle must possess a valid, unrestricted motorcycle operator’s license recognized in the destination countries (including an International Driving Permit, if applicable).
• Skill Level: You acknowledge that motorcycle touring requires a high degree of physical fitness, mental alertness, and technical riding skill. The Company reserves the right to prevent any participant from riding if, in our sole discretion, their riding behavior poses an immediate safety hazard to themselves or the group. No refunds will be provided in this scenario.
• Passports & Visas: Participants are completely responsible for ensuring their passports, visas, and health documentations are valid for entry into the tour destinations.

6. Absolute Release and Assumption of Risk

Motorcycle touring involves inherent risks, including property damage, severe illness, personal injury, or death. By participating, you knowingly and voluntarily assume all such risks.

You hereby release, waive, discharge, and covenant not to sue MONTBLVN LLC, its officers, employees, or contractors from any and all liability, claims, or demands arising out of personal injury, illness, death, or property loss sustained during an Adventura Motorcycle Tours itinerary.

7. Governing Law and Jurisdiction

These Terms & Conditions are governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law principles. Any legal actions or proceedings arising from these terms must be brought exclusively in the courts located in New Mexico, USA.
